PRIVACY POLICY REGARDING THE PROTECTION OF PERSONAL DATA OF USERS OF THE YOGIST WEBSITE AND SERVICES

1. Purpose of this charter

At YOGIST, protecting your personal data is a top priority!

The purpose of this policy is to inform you about how we process your personal data.

Rest assured, we comply with the 1978 French Data Protection Act and the European General Data Protection Regulation of April 27, 2016 (hereinafter: the “GDPR” ) when collecting and managing your data.

2. What is personal data?

When you use the YOGIST Chatbot (hereinafter referred to as the “Chatbot” ), we may ask you to provide us with personal data about yourself in order to use our services.

The term “personal data” refers to any data that can be used to identify you as an individual.

3. What personal data does YOGIST collect?

As part of our business operations, we collect certain information about you, including your first name and email address, connection data (IP address and logs), and internet data (cookies). We do not collect any medical data.

If you use the Chatbot on yogist.io (covered by this statement regarding the domains yogist.io, yogist.fr, and yogist.com), the following data may be collected when you use the Chatbot:

  • Name/Username
  • Email
  • Account creation date and IP address
  • Video views
  • Top video platforms
  • Time and dates of the reminders

4. Who is the data controller?

We! YOGIST, a simplified joint-stock company registered with the Paris Trade and Companies Register under No. 813 655 263, with its registered office at 4 Rue Feutrier – 75018 Paris (hereinafter: “we” ).

5. On what legal basis(es) is your data collected and used?

The legal basis for our collection of your personal data is as follows:

  • The legitimate interest arises when you voluntarily provide us with personal data while using our chatbot; this data is collected to enable us to better respond to your requests for information about our Services.
  • If this data collection is necessary to fulfill the contract entered into when you use our services via our chatbot.
  • When the processing of your data is necessary to comply with a legal obligation to which we are subject.

6. For what purpose(s) is your data collected and used?

Your personal data is collected for one or more of the following purposes:

  • Create a user file;
  • Manage your access to and use of the Chatbot services;
  • Compile usage statistics for our chatbot;
  • Customize responses to your requests for information;
  • Manage user feedback on the chatbot's services or content;
  • Sending information, excluding any commercial solicitation, particularly via Pipedrive, for the purpose of sending newsletters;
  • Compliance with our legal and regulatory obligations.

Note: You are always free to decline to provide us with your data; in such cases, we will inform you of the potential consequences of your refusal if the data is required.

7. Recipients of the collected data

The following will have access to your personal data:

  • Our team,
  • The entities responsible for oversight (including the independent auditor),
  • Our subcontractors,
  • Partners with whom we may work to carry out our services, with your consent, such as Pipedrive.

Not to mention (less exciting) public agencies, judicial officers (bailiffs, notaries, etc.), court officers, and debt collection agencies.

Please be assured that your personal data will never be sold, leased, or shared with third parties.

8. Retention period for personal data

Your data will be retained for the duration of your registration with the chatbot, and for a period of:

  • Three (3) years from the date you unsubscribe, with regard to the use of your data for marketing purposes. At the end of this three (3)-year period, we may contact you again to ask if you would like to continue receiving marketing communications.
  • At least three (3) years from the date you exercise your right to object, regarding the information necessary to process your request.
  • Five (5) years from the date you unsubscribe, for the purpose of complying with legal and regulatory obligations, as well as to establish proof of a right or a contract.
  • Thirteen (13) months for the cookies referred to in Section 6.

9. Safety

Don't worry! We (and our subcontractors) have taken all necessary precautions, as well as the appropriate organizational and technical measures, to ensure the security, integrity, and confidentiality of your personal data.

10. Accommodations

Your data is retained and stored on servers located in Ireland for the entire duration of its processing.

Your data will not be transferred outside the European Union in connection with your use of the services we provide.

11. Cookies

Cookies are text files, often encrypted, that are stored on your computer. They are created when your computer visits a website: the website sends information to your computer, which then creates a text file. Every time you return to the same website, your computer retrieves this file and sends it back to the website.

There are different types of cookies, each serving a different purpose:

  • Technical cookies are used throughout your browsing session to enhance your experience and enable certain features. For example, a technical cookie may be used to save the information you enter in a form or your preferences regarding language or website layout, when such options are available.

We use technical cookies.

  • Social media cookies may be set by social media platforms to allow website developers to share their content on those platforms. In particular, these cookies may be used by social media platforms to track users’ browsing activity on the relevant website, regardless of whether or not users accept these cookies.

We do not use social media cookies.

We also encourage you to review the privacy policies of the social media platforms that set these cookies to learn how they use the browsing information they may collect through these cookies and how to exercise your rights with these platforms.

  • Advertising cookies may be set not only by the website you are visiting, but also by other websites that display ads, banners, widgets, or other elements on the page you are viewing. These cookies may be used, in particular, to deliver targeted advertising—that is, advertising tailored to your browsing activity.

We also do not use advertising cookies.

Please note that you can refuse the use of cookies. However, doing so may prevent the chatbot from functioning properly.

12. Your rights

What are your rights regarding your data?

Right to Information

That is precisely why we have drafted this charter.

Right of access

You have the right to access all of your personal data at any time.

Right to rectification

You have the right to correct any inaccurate, incomplete, or outdated personal data at any time.

Right to restriction

You have the right to restrict the processing of your personal data in certain cases specified in Article 18 of the GDPR.

Right to data portability

You have the right to receive your personal data in a machine-readable format and to request that it be transferred to a recipient of your choice.

Right to be forgotten

You have the right to request that your personal data be deleted and to prohibit any future collection of such data.

Right to file a complaint

You have the right to file a complaint with a competent supervisory authority (in France, the CNIL) if you believe that the processing of your personal data violates applicable laws.

Right to object

You have the right to object to the processing of your personal data. Please note, however, that we may continue to process your data despite your objection, for legitimate reasons or to defend our legal rights.

If you wish to opt out of marketing communications, you can do so at any time by clicking the unsubscribe link at the bottom of each of our marketing emails.

The right to make advance directives

These guidelines pertain to the retention, deletion, and disclosure of your personal data, and designate a person responsible for their implementation where applicable.

You may submit them to a trusted third party certified by the CNIL for general guidelines, or to the contact information below for specific guidelines.

You can change or revoke your instructions at any time.

13. Entry into force

This policy took effect on May 27, 2019, and was last amended on September 13, 2024.

14. Changes

We reserve the right, at our sole discretion, to modify this policy, in whole or in part, at any time.

You will be notified of this update via a message that will appear the next time you open the chatbot.

These changes will take effect upon publication of the new Terms of Service. Your continued use of the Chatbot after these changes take effect constitutes your acknowledgment and acceptance of the new Terms of Service. If you do not agree to these changes, you must stop using the Chatbot.
